1) Term of the Agreements: The term of this Agreement will begin upon our acceptance of your Affiliate application and will end when terminated by either party. 

Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination. You are only eligible to earn referral fees on sales occurring during the term.  

If terminated for cause, meaning a violation of our Terms of Service, Standards of Conduct, or objectionable material, you will forfeit any and all pending or future compensation.

Read and indicate your acceptance of this agreement by checking the boxes above and clicking the 'I Agree' button below.  You will be taken to our application form where you'll be asked to provide contact information and be assigned your unique affiliate tracking code.

We reserve the right to terminate any affiliate that gives us reasonable cause to do so.

2) Modification: From time to time, we may modify the terms and conditions contained in this Agreement. We agree to make these
changes in good faith and will post a change notice on our Web site when we make any such changes. 

We will notify you by email at the address you provide us of any substantive changes to the terms of this Agreement. 

Modifications may include, for example, changes in the commission schedule, any bonus payments, payment procedures and
Program rules. 

IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, PLEASE CONTACT US WITHIN 30 DAYS OF OUR EMAIL NOTICE TO YOU. IT MAY BE
THAT YOUR ONLY RECOURSE WILL BE TO TERMINATE THIS AGREEMENT, BUT WE WOULD LIKE TO DISCUSS YOUR CONCERNS BEFORE THAT HAPPENS. IF YOU DON'T CONTACT US WITHIN 30 DAYS OF OUR EMAIL NOTICE, WE WILL ASSUME THAT YOUR CONTINUED PARTICIPATION IN THE PROGRAM MEANS THAT YOU HAVE ACCEPTED THE CHANGE.

3) Limitation of Liability: We will not be liable for indirect, special or consequential damages, or any loss of revenue, profits or data, arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total referral fees paid or payable to you under to this Agreement.

4) Independent Investigation: YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU UNDERSTAND THAT WE MAY AT ANY TIME (DIRECTLY OR INDIRECTLY) SOLICIT CUSTOMER REFERRALS ON TERMS THAT MAY DIFFER FROM THOSE CONTAINED IN THIS AGREEMENT OR OPERATE WEB SITES THAT ARE SIMILAR TO OR COMPETE WITH YOUR WEB SITE. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.

5) Miscellaneous: This Agreement will be governed by the laws of the United States and the State of Nevada, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the federal or state courts located in Nevada, and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of and be enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

6) Web Site Approvals:

We reserve the right to reject affiliates marketing our program on sites promoting such things as pornography, violence, illegal activities, etc, at our sole discretion and judgment.

Once approved, affiliates will be provided an opportunity to remove objectionable material prior to being removed from the program.

We expect to approve most affiliate applications within 48 hours of submission of our application. 

7) Compensation

Commissions are paid on gross sales actually collected from customers. 

You understand you are acting as an independent party and as such are responsible for your own taxes and any other liabilities. You agree that you are not authorized to act on our behalf other than marketing our products and services as an independent party for a commission.

Commissions are only paid on orders that are paid in full. If transactions incur a charge back it will not count towards affiliates commissions. If commissions have already been paid on a charge back, that amount will be deducted from future affiliate commissions. 

We have a two tier compensation schedule that compensates you for individual sales and the sales of affiliates that you refer to us.  As you produce more, you will earn higher commissions.  The percentages apply to new sales and renewals for ListChannel.com and SendInfo.Net.  Future products and services may have a different compensation schedule.

Entry Affiliate: 1 to 5 personal sales.
    15% of personal referred sales
    7.5% of referred affiliate sales

Active Affiliate: 6-10 personal sales
    17.5% of personal referred sales
    8.75% or referred affiliate sales

Promoting Affiliate: 11+ personal sales
    20% of personal referred sales
    10% of referred affiliate sales

Paying customers receive a 5% bonus on personal referred sales and 2.5% bonus on referred affiliate sales.  (e.g. Entry affiliate that is a customer would earn 20% on personal sales and 10% on referred affiliate sales)

At some point in the future, we may stop accepting new affiliate applications and allow new affiliates only as replacements for dropped or non-performing affiliates.    

• You will receive compensation for of all your customer referrals renewals for as long as they remain a customer and you remain an affiliate in good standing.
• You will receive compensation for all initial orders placed through affiliates that sign up using your affiliate ID.
• You will receive compensation of all renewals of  customer orders placed through affiliates that sign up using your affiliate ID.
• Your payment will be on the way on or before the 15th of each and every month for all payments received the previous calendar month.
• You may select payment through PayPal or by Check.   Payments have a $25.00 monthly minimum. Amounts less than the minimum will be added to the following month(s) until the minimum is reached.
• You will be paid for all orders taken and paid, whether by our secure online order form, phone, fax, or postal mail as long as your affiliate ID, name, list name, or email address  is provided with other than online orders.
• U.S. residents are obliged to complete and return by postal mail a fully completed w9 before they will be paid in excess of $600 US in one calendar year.
• Purchases you make on your own affiliate account will be credited to your referring affiliate.
